FAMILY LAW

DIVORCE LAW

Divorce law is a particularly dynamic area of family law that is constantly adapting to social developments. Even if the reason for a separation or divorce is rarely a happy one, divorce law represents a central legal framework in this phase of life.

Numerous legal issues become relevant at the latest with a separation - from the division of assets and maintenance claims to custody and access rights. Divorce is therefore always a sensitive issue that requires not only legal clarity but also a high degree of empathy.

The parties involved are often faced with emotional and legal challenges, especially when it comes to questions of custody or maintenance. Our aim is to provide support in such situations with a sense of proportion and structure, to develop viable solutions and - if possible - to promote an amicable settlement. In doing so, we rely on goal-orientated advice and, where necessary, consistent representation of our clients' interests.

MAINTENANCE LAW

Maintenance law deals with the financial equalisation between people who are in a family or legally regulated close relationship with each other and where at least one person cannot fully support themselves.

Separation maintenance plays a special role here. Here, the entitlement is generally based on the previous standard of living in the marriage or partnership. Who is entitled or obliged to pay maintenance in individual cases is determined by the statutory regulations and the individual living conditions.

Maintenance claims can exist in favour of children, (spouses) partners, divorced partners or parents. Under certain circumstances, maintenance obligations can also be considered between unmarried partners, for example if the relationship has produced joint children.

We advise and represent our clients in the clarification, calculation and enforcement of maintenance claims as well as in the defence against unjustified claims - with the aim of achieving fair and legally secure solutions.

CAREFUL

Parental custody encompasses the right and at the same time the duty of parents to look after the welfare of a minor child. This includes, in particular, the upbringing, care and provision of the child as well as the defence of their legal and economic interests. The legal basis for this is set out in Sections 1626 to 1698b of the German Civil Code (BGB).

Parental care is divided into several areas: Personal care, property care and legal representation of the child. These areas concern both everyday decisions and fundamental questions about the child's development and future.

Irrespective of parental custody, both parents are obliged to provide for the child's maintenance. They are legally obliged to ensure the financial support of their child.

MARRIAGE CONTRACT

A prenuptial agreement is a contract under private law between spouses, with which individual agreements can be made for the marriage and, in particular, in the event of a later separation or divorce. The aim is to create solutions that deviate from the standard legal regulations and are customised to the personal and economic situation.

Marriage contracts often contain provisions on the matrimonial property regime and thus the division of assets in the event of a divorce. In addition, agreements can be made on pension equalisation, pension entitlements and post-marital maintenance.
